The Supreme Court voted 5–4 to temporarily put on hold the U.S. Environmental Protection Agency’s (EPA) “good neighbor” rule that cracks down on states whose industries are said to be contributing to smog.
Justice Neil Gorsuch wrote the Court’s majority opinion.
Justices Amy Coney Barrett, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented.
The dispute before the nation’s highest court is whether the plan should be in effect while the controversy is sorted out by lower courts.
After the Supreme Court rules in the current case, the issue may return to the Court.
